Chitungwiza residents suing July Moyo over poor drainage

Two Chitungwiza residents have reportedly filed an urgent application at the High Court as they argued that the Local Government’s failure to install proper drainage systems infringes on their constitutional rights, The Standard reports.

The duo Daniel Tapfira and Emmerson Shereni Ndokwani’s founding affidavit which cited Chitungwiza Mayor and July Moyo as respondents, wants Chitungwiza and the government to install functional water drainage systems in the town:

My house is on a corner stand and the storm water drain pipes and bridge near my house have collapsed due to lack of maintenance by council.

When we experience heavy rains, the surface runoff water collects in the broken storm water drain, which is adjacent to my house and cannot be channelled anywhere as the pipes are broken.

The water, therefore, accumulates into my yard and into my house. The floods are also a result of first
and second respondents’ failure to have a comprehensive and sound policy and plan to deal with settlements on wetlands and respondents’ failure to develop local environmental action plans, which maintain wetlands as open spaces so that they perform their natural functions of absorbing water and avoid flooding.

Moyo and Chitungwiza Town Mayor are yet to respond to the applicants. Parts of Chitungwiza earlier this month flooded as heavy rains befell the town.
