Tendai Biti, the Vice President of opposition MDC Alliance, has said the March Supreme Court (SC) ruling on MDC leadership crisis did not give the reinstated MDC-T interim leadership the power to recall members.

Biti made the remarks before High Court judge Justice Pisirai Kwenda who presided over a case in which Thokozani Khupe’s MDC was challenging the court’s jurisdiction in presiding over cases brought by recalled legislators.

Recalled MDC Alliance legislators Chalton Hwende, Prosper Mutseyami, Thabita Khumalo and Lilian Timveos had approached the High Court after they had been recalled.

Biti said the MDC-T’s interim leadership is there only for purposes of steering the party in preparation of the court-sanctioned extraordinary congress. He said:

The Supreme Court judgment gives a narrow bridge versus the succession issue, but now Mwonzora thinks he has powers. The judgment cannot be vandalised in the manner that Mwonzora is doing.

That judgment presupposes freezing of a button until someone fills the big shoes of the late leader Morgan Tsvangirai. So, when Mwonzora writes those letters he cannot derive paternity from that judgment.

That judgment was to remedy the mischief of the manner in which Tsvangirai was succeeded.

Mwonzora does not become the secretary-general, but is there for purposes of creating a road map to the congress.

Since March, MDC-T has recalled over 30 MDC Alliance legislators and councillors for allegedly ceasing to serve the party’s interests after they continued to show allegiance to Khupe’s nemesis Nelson Chamisa.
