Home seekers drags Chiyangwa to court for evicting them

At least 30 home seekers have dragged businessman Philip Chiyangwa to the High Court after he allegedly caused their eviction from an Old Citrus farm in Chinhoyi.
The 30 led by Abigail Dzepasi have claimed that the former football boss backed by members of the Zimbabwe Republic Police have been harassing them and displacing them from their homes.
In an urgent chamber application for an interdict, the villagers claim their properties have been damaged and some were injured after violence erupted between them and police.
The skirmishes have persisted since September 24 to date.
“The applicants are being unlawfully evicted from Old Citrus farm in Chinhoyi in Mashonaland West province by Philip Chiyangwa’s agents, employees and security officers with the assistance of the members of the Zimbabwe Republic Police without any valid court orders.
“The conduct by Chiyangwa is wrongful and unlawful. The Officer commanding Mashonaland West province has not secured an alternative place to resettle the applicants and neither has he complained against the applicants,” she said.
Dzepasi claimed Chiyangwa has not provided any alternative for the families he is evacuating.
“The applicants have not been allocated an alternative place to go by the ministry of lands
“From September 24 to date, Chiyangwa, members of police and his agents are intimidating, harassing, assaulting and unlawfully ejecting the applicants from their homesteads,” she said.
She said their rights are being violated.
“The rights of the applicants to land, against arbitrary eviction and protection from inhuman and degrading treatment have been and continue to be abrogated.
“The balance of convenience favours the granting of relief sought to prevent irreparable harm to the applicant,” she said.
According to Dzepasi some of the members who were arrested during the clashes appeared at the Chinhoyi magistrate court before they were released on ZWL$2 000 bail.
Police Officer-In-Charge Chinhoyi rural, Officer Commanding mash-west and Lands minster have been cited as respondents.
